India's Supreme Court to hear Meta and WhatsApp's appeal against a $26M penalty over 2021 privacy policy changes.
The Supreme Court of India will hear appeals from Meta and WhatsApp on February 23, 2026, challenging a ₹213.14 crore penalty imposed by the Competition Commission of India over their 2021 privacy policy changes.
The CCI found the policy violated competition laws by restricting user choice and consolidating data control.
The court has expressed strong concerns about the policy’s complexity, lack of informed consent, and potential misuse of user data, particularly for digitally unaware individuals.
While the National Company Law Appellate Tribunal upheld the fine and extended privacy protections to all data sharing, it overturned a five-year ban on advertising-related data sharing.
The Supreme Court will issue an interim order by February 9, has added India’s Ministry of Electronics and Information Technology as a party, and will consider a cross-appeal from the CCI challenging the NCLAT’s decision.
