Montana’s TikTok ban, passed in 2023 but never enforced, has been dismissed after the state and TikTok agreed to end a federal lawsuit.
The law, which would have been voided if TikTok were owned by a non-China-based company or a foreign adversary, is now unenforceable due to TikTok’s 2026 formation of a U.S.-based entity, the TikTok USDS Joint Venture, owned by Oracle, Silver Lake, MGX, and a minority stake by ByteDance.
The joint dismissal confirms the ban’s invalidity, concluding nearly three years of legal conflict.
Montana’s Attorney General Austin Knudsen said the new ownership addresses national security concerns and called the outcome a victory for public safety and taxpayer savings.
