California introduces law to combat AI fraud and deepfakes, expanding defamation penalties and streamlining removal of non-consensual AI content.
State Sen. Josh Becker, D-Menlo Park, introduced the Digital Dignity Act on Feb. 19 to strengthen California’s laws against AI-driven fraud and defamation.
The bill clarifies that using AI-generated digital replicas to impersonate individuals without consent falls under existing defamation laws and increases penalties for harm caused.
It also creates clearer processes for removing unauthorized AI-generated images, especially non-consensual explicit content or scam-related deepfakes.
The legislation responds to real cases, including a scam where a deepfake of actor Steve Burton defrauded a woman and AI tools used to generate explicit images of women without consent.
The bill now moves to the Senate Rules Committee for referral to a policy committee, with further review pending.
