Supreme Court rules Meath County Council doesn’t must make Local Area Plan due to new laws making it pointless.
The Supreme Court has ruled that Meath County Council will not be forced to prepare a Local Area Plan for East Meath, stating that recent legislative changes rendering such an order futile and inappropriate.
Although the court previously found the council’s failure to begin the plan was unlawful, a new standing order effective December 31, 2025, replaced the old planning framework, making the original remedy ineffective.
The environmental group Protect East Meath Ltd, which had sought a mandamus order, did not request an order for an Urban Area Plan, the new relevant planning instrument, and there was no evidence the council was failing in its current obligations.
The group was awarded legal costs.
