A deaf Irishman won €40,000 in compensation after a tribunal ruled his employer discriminated against him by demanding a formal sign language certification he didn’t need.
Noel O’Connell, a deaf man and PhD holder in deaf education, was awarded €40,000 in compensation after Ireland’s Workplace Relations Commission ruled the National Council for Special Education (NCSE) indirectly discriminated against him by requiring a formal Irish Sign Language qualification for an advisor role, despite his fluency as a native ISL user and extensive experience.
The tribunal found the NCSE failed to act on a favorable internal review that deemed O’Connell’s qualifications equivalent, violating its own hiring code and causing disproportionate harm to deaf applicants.
The ruling overturned the usual €13,000 compensation cap, citing the need for effective remedies under European law.
