A judge dismissed a lawsuit over Buffalo Wild Wings' "boneless wings," saying the term isn't misleading.
A U.S. federal judge in Illinois dismissed a 2023 lawsuit against Buffalo Wild Wings, ruling that the plaintiff, Aimen Halim, failed to provide sufficient evidence that consumers are misled by the term "boneless wings."
Judge John Tharp stated that "boneless wings" is a widely recognized menu term used for over two decades and that reasonable consumers understand the product is made from chicken breast, not actual wing meat.
The judge emphasized that the term is not deceptive, comparing it to other common menu descriptors like "chicken fingers," and allowed Halim until March 20 to amend his complaint with additional facts.
The decision permits Buffalo Wild Wings to keep its current labeling.
