The City of Peoria has dropped its lawsuit against Boyd Gaming over the Par-A-Dice Casino renovation, filing a motion to dismiss after Boyd presented a revised plan to move the gaming floor to a permanent barge on the Illinois River.
The original legal challenge argued the land-based casino violated the Illinois Gaming Act and a 1991 agreement.
The Illinois Gaming Board postponed final approval, setting a special meeting for February 26.
Peoria said it may refile the lawsuit if Boyd returns to a land-based design.
Prior to the lawsuit, the city council had debated approving the original plan in exchange for a share of the casino’s annual revenue, estimated at $1.8 million.
