The Supreme Court of India, in a bail hearing on February 16, 2026, advised caution in pre-marital physical relationships, stating that men and women before marriage are "total strangers" and should be wary of intimacy.
The remarks came in a case where a man is accused of rape based on a false promise of marriage, despite being already married and later marrying another woman in January 2024.
The court questioned why the woman traveled to Dubai for a consensual relationship, suggesting the circumstances warranted caution.
While acknowledging the relationship was consensual, the bench emphasized that deception in marriage promises could vitiate consent and recommended mediation and compensation over prosecution.
The case, previously denied bail by lower courts, was adjourned for Wednesday to explore a possible settlement.
