India’s Supreme Court is set to hear challenges to Section 44(3) of the Digital Personal Data Protection Act, 2023, which amended the Right to Information Act by removing the public interest exception for personal data disclosure.
Petitioners, including journalists and transparency advocates, argue the change creates a blanket denial of information requests about public officials and government actions, undermining accountability and violating constitutional rights to free speech and transparency.
They also criticize broad data access powers granted to the central government and concerns over the Data Protection Board’s independence.
The case, pending since November 2025, will be heard on February 16, 2026, by a bench led by Chief Justice Surya Kant.
