A tour bus driver, Bin Shao, 56, of Flushing, New York, has been indicted on five counts of second-degree manslaughter and five counts of criminally negligent homicide in connection with a fatal crash on I-90 near Pembroke on August 22, 2025.
The bus, carrying over 50 people returning from Niagara Falls, rolled over, killing five and injuring many, including three children.
Shao, who was the sole driver, pleaded not guilty.
Authorities confirmed no evidence of drug or alcohol impairment, and the charges stem from his actions while operating the vehicle.
A grand jury indicted him on February 11, 2026, and he is scheduled to appear in court on March 9.
If convicted, he could face five to 15 years in prison.
The bus company, M&Y Tour Inc., is not facing criminal charges.
