The Montana Supreme Court unanimously upheld the 2022 conviction of Sean Doman, a Kalispell man arrested for obstructing a peace officer while recording a traffic stop.
The court ruled that Doman’s refusal to comply with lawful orders to move away from the scene—despite multiple warnings—justified his arrest, even though he had a right to record police activity.
While acknowledging the importance of public recording, the justices said such rights do not override lawful police commands.
The decision, based on evidence that Doman’s conduct interfered with law enforcement, was unanimous, with Justice Jim Shea praising the officer’s calm demeanor during the encounter.
