A federal judge has ruled that ICE must permit Catholic clergy to distribute ashes and administer Communion to detainees at the Broadview, Illinois, facility on Ash Wednesday, citing violations of religious freedom.
The decision, issued by Judge Robert W. Gettleman on Feb. 12, 2026, follows a lawsuit by the Coalition for Spiritual and Public Leadership, which challenged ICE’s recent restrictions that blocked spiritual care, including at Christmas.
The judge found the government failed to justify the restrictions as necessary or the least restrictive means, ordering ICE to coordinate with the group to establish safe protocols for future services.
The ruling affirms the spiritual rights of detained migrants, with clergy expected to conduct Ash Wednesday services and a public Mass planned in Melrose Park to show solidarity.
Neither ICE nor DHS has publicly responded.
