A Jehovah’s Witness healthcare assistant in Ireland has lost her discrimination claim after being asked to accompany residents to Mass, with the Labour Court ruling the Health Service Executive did not violate the Employment Equality Act.
Judyta Zielinska, who has worked in care since 2015, said the requests caused her severe stress, but the court found she failed to prove she was treated less favorably than others due to her religion.
While acknowledging her distress, the court noted she was never required to attend Mass, only to accompany residents, a task consistent with her job duties, and provided no evidence of differential treatment or adverse impact.
The decision upholds a 2024 finding by the Workplace Relations Commission.
