After years of legal challenges, a South Carolina judge denied a motion to reconsider a December 2025 decision, citing the group’s failure to disclose the pole’s height to local authorities despite reporting it to the FAA.
The court ruled the group lacked “clean hands,” and enforcement was reinstated, leading to the flag’s removal before the February 5 deadline.
The case remains pending before the South Carolina Court of Appeals.
