A New Zealand court reviews whether an archaeological permit for a development on sacred Māori land was properly granted.
A New Zealand Environment Court is reviewing a dispute over a proposed residential development on the Ōpihi Block near Whakatāne, a site sacred to Māori trustees who believe it spans 600 acres and contains ancestral burial grounds.
The case challenges Heritage New Zealand’s granting of an archaeological authority for the 26.9ha project, with trustees arguing the agency failed to consult them properly and did not refer the matter to the Māori Heritage Council, as required.
Despite a modified plan with fewer lots and a 300-meter buffer, opposition remains.
Judge Jeff Smith emphasized that participation in discovery protocols does not equal consent.
The court will decide whether to overturn the authority or send it back for review.
