Lead investigator Nomsa Masuku testified that she protected witness Marius van der Merwe, who was later killed, due to threats, and the 2022 murder case now has strong evidence and two suspects, with a prosecution decision expected by late February 2026.
Nomsa Masuku, lead investigator in the 2022 murder of Emmanuel Mbhense, testified before the Madlanga Commission about her efforts to protect Witness D, Marius “Vlam” van der Merwe, a key source who was later killed in December 2025.
She revealed she withheld his statement since 2022 to prevent harm, citing threats including a 2023 car attack that left her son wheelchair-bound and a 2024 shooting.
Masuku said the case has faced delays due to police inaction and the National Prosecuting Authority’s initial refusal to act, but now has strong evidence and two new suspects.
The NPA is expected to decide on prosecution by the end of February 2026.
