EU may reclaim €10B from Hungary over rule-of-law breaches, ahead of elections.
The European Court of Justice’s advocate general has recommended the EU recover over €10 billion in cohesion funds granted to Hungary in 2023, stating Budapest failed to meet rule-of-law conditions tied to the disbursement.
The funds were released after Hungary’s prime minister, Viktor Orbán, reversed his opposition to a €50 billion military aid package for Ukraine, prompting concerns of a political trade.
The European Commission had previously suspended the funds over democratic backsliding, corruption, and weakened judicial independence.
Advocate General Tamara Ćapeta found the Commission did not properly verify reforms or justify the release, and her non-binding opinion is expected to influence the court’s final ruling, possibly requiring repayment or future funding cuts.
The decision comes ahead of Hungary’s April parliamentary elections and could set a major precedent for EU enforcement of governance standards.
