Kerala court grants bail to former MLA Rahul Mamkootathil in first rape case, citing weak evidence and strict conditions.
The Kerala High Court granted anticipatory bail to former Congress MLA Rahul Mamkootathil on February 12, 2026, in the first of three rape cases against him, citing insufficient evidence to prove rape at this stage.
The court, led by Justice Kauser Edappagath, imposed strict conditions: surrendering his passport and mobile phone, appearing before police every second Saturday, undergoing medical exams, and refraining from leaving Kerala or contacting witnesses.
The decision follows previous bail grants in two other cases and comes amid allegations of forced abortion, threats, and coercion, though the court noted inconsistencies in the complainant’s statements and acknowledged a prior consensual relationship.
Mamkootathil, expelled from the Congress party and suspended in August 2025, remains an MLA for Palakkad.
The investigation in the first two cases has been transferred to the State Police Crime Branch.
