The Fair Work Ombudsman alleges they entered an exclusion zone without authorization, breaching health and safety protocols.
The case, set for a May 25 directions hearing, could result in fines of nearly $20,000 each for the individuals and up to $99,000 per violation for the union.
The proceedings come as a Queensland inquiry into union misconduct resumes, with testimony expected from former report author Geoffrey Watson and civil contractors’ chief Damien Long.
The CFMEU has been under federal administration since 2024 due to allegations of organized crime influence.
