A lawsuit filed at the Florida Supreme Court challenges Governor Ron DeSantis' authority to call a special legislative session in April to redraw congressional district maps mid-decade, arguing that only the Legislature has the power to redistrict under the state constitution’s separation of powers doctrine.
Backed by the National Redistricting Foundation, the suit contends DeSantis’ proclamation and related directives to the Secretary of State violate constitutional principles and the “Fair Districts” amendment, which bans partisan gerrymandering.
The case arises amid a national trend of mid-decade redistricting, with Republicans currently holding 20 of Florida’s 28 congressional seats.
The Florida Supreme Court previously upheld a prior map drawn under DeSantis’ influence despite similar concerns.
The lawsuit seeks to invalidate the governor’s order if he cannot prove legal authority.
DeSantis’ office did not respond to requests for comment.
