Jaiken Richard Fitzpatrick, 41, was sentenced to two years and three months in prison for the manslaughter of his father, Kenneth Fitzpatrick, 69, in Berowra Heights, NSW, on September 7, 2023, after pleading guilty.
The death occurred during a struggle over a car, with Kenneth dying from exertion due to his underlying health conditions, including prostate cancer and recent heart surgery.
The court heard Jaiken, who had severe mental health issues and substance use, was under the influence and acting impulsively.
The charge was downgraded from murder.
Due to time already served, he was immediately released on parole, with his sentence ending in May 2027.
The judge acknowledged the family’s grief and Jaiken’s remorse and rehabilitation efforts.
