A cyclist’s family can’t get compensation after a crash with an uninsured, deceased driver, exposing a gap in India’s road safety policy.
The Motor Accident Claims Tribunal in New Delhi has identified a gap in India’s road accident compensation system after a cyclist died in a crash with an uninsured vehicle driven by a man who also died.
The victim’s family—his wife and two children—cannot receive compensation because the driver was deceased with no estate, the vehicle had no insurance, and existing schemes don’t apply since the driver was identified, not a fugitive.
The tribunal called the situation a “policy vacuum” and urged the Ministry of Road Transport and Highways to explore relief options, directing the ministry to respond by February 27.
