Fiji’s High Court ruled Prime Minister Rabuka unlawfully fired anti-corruption chief Malimali, ordering her reinstatement.
The High Court of Fiji declared that the dismissal of anti-corruption chief Barbara Malimali in June 2025 was illegal, citing Prime Minister Sitiveni Rabuka's lack of constitutional authority to advise the President to do so. According to Justice Dane Tuiqereqere, Fiji's 2013 Constitution only permits the Judicial Services Commission, not the Prime Minister, to suggest the appointment or dismissal of FICAC Commissioners. Rejecting arguments that the JSC was incapacitated, the court upheld Malimali's judicial review, ordered her reinstatement, and awarded her FJ$7,500 in legal fees. Malimali hailed the decision as a triumph for the rule of law, while the government intends to file an appeal.
