A judge increased sentencing for a man who repeatedly entered his partner’s home despite a court ban, adding time, community service, and strict probation conditions.
Ontario Court Justice Andrew Buttazzoni rejected a joint sentencing proposal for Darren Ervin, a Sault Ste.
Marie man who repeatedly violated a court-ordered undertaking by entering his partner’s west-end apartment despite being barred.
Ervin, who pleaded guilty to 10 charges including assault and seven breaches of undertaking between December 2024 and January 2026, was seen refusing to leave the residence on January 8, prompting police to obtain a warrant after he remained inside for over five hours.
The judge called the situation a "horrendous waste of time" and increased Ervin’s pre-sentence custody from 24 to 36 days, added 20 hours of community service, and imposed a one-day time-served sentence.
Ervin was placed on 12 months of probation with conditions including mandatory substance abuse counselling, a ban on contacting his partner unless she consents, a DNA sample requirement, and a three-year weapons prohibition.
He apologized, expressing deep remorse.
