The FTC has warned 42 major law firms that their participation in the Mansfield Certification program may violate antitrust laws by creating coordinated diversity hiring efforts that could distort labor market competition.
The program, run by Diversity Lab and modeled after the NFL’s Rooney Rule, encourages firms to consider diverse candidates for leadership roles, but the FTC argues such collaboration—especially around shared metrics and strategy meetings—may suppress pay and limit competition.
The firms, including Skadden, Latham & Watkins, and Covington & Burling, had previously engaged in DEI initiatives, some of which were challenged or settled under Trump-era policies.
The FTC’s action follows a broader federal push to roll back DEI programs, including a 2025 court ruling upholding the program’s legality.
The White House directed inquiries to the FTC, and the firms did not immediately comment.
