A 17-year-old teenager accused of raping a 15-year-old girl has lost his appeal to dismiss the trial, despite claiming prosecutorial delays caused severe stress due to ADHD and Asperger’s.
The alleged victim reported the assault immediately, and the case has been pending for over three years.
Ireland’s High Court and Court of Appeal both ruled the public interest in prosecuting the serious offense outweighed the accused’s personal hardship, noting he would retain anonymity and benefit from youth sentencing if convicted.
The courts found no evidence the delay significantly worsened his mental health.
The trial will proceed.
