A group challenging Illinois' law blocking use of "Democrat" in org names sues, citing First Amendment rights.
A nonprofit group, Democrats for an Informed Approach to Gender (DIAG), is suing Illinois over a 1986 law requiring political party approval to use “Democrat” or “Republican” in an organization’s name.
The group, which opposes certain transgender policies and identifies as former or current Democrats, says it has been denied registration three times and cannot operate in Illinois despite being recognized in 37 other states.
Represented by FIRE, DIAG argues the law violates the First Amendment by restricting political speech based on content and speaker.
The lawsuit claims the state’s requirement gives political parties undue control over common political terms and infringes on free expression.
Illinois has not yet responded to the legal challenge.
