A federal court ruled Secretary Noem illegally ended TPS for Venezuelans and Haitians, citing lack of authority and bias.
A federal appeals court determined that Homeland Security Secretary Kristi Noem had overreached her authority under the 1990 Immigration Act and had unlawfully terminated Temporary Protected Status (TPS) for Venezuelans and Haitians.
The 9th Circuit Court of Appeals unanimously upheld a lower court decision, stating the law does not allow unilateral termination of TPS without proper procedures.
The court cited evidence of racial and national origin bias, including stereotyping immigrants as dangerous or mentally unstable, and concluded that the administration's claims of improved conditions in Venezuela and Haiti were unsupported.
The Supreme Court previously permitted the termination to take effect pending final review, so even though the decision is legally significant, protections won't be immediately restored.
