The EPA, under Administrator Lee Zeldin, is proposing to roll back the "good neighbor" rule, allowing eight states—Alabama, Arizona, Kentucky, Minnesota, Mississippi, Nevada, New Mexico, and Tennessee—to regulate their own ozone pollution without federal oversight.
The move follows a 2024 Supreme Court decision that invalidated the rule, which required states to limit pollution crossing state lines.
The EPA claims the states’ plans have sufficient data to show they won’t harm downwind air quality and supports "cooperative federalism."
Environmental groups warn the change could worsen air pollution in neighboring states and increase health risks.
Public comment will be accepted for at least 30 days before finalization.
