The lawsuit claims the state violated mandatory rulemaking procedures by lowering income eligibility for the AIDS Drug Assistance Program (ADAP) from 400% to 130% of the federal poverty level without proper notice or public input.
AHF argues the change threatens public health and could worsen Florida’s high HIV infection rates.
The group is seeking an expedited hearing to block the rule changes, following a January 2026 rally and acknowledgment from state leaders of the issue’s seriousness.
