The move, aligned with Trump’s legal team, argues the probe lacked legal authority and was politically motivated.
The report, part of a two-volume investigation into Trump’s handling of classified materials and election-related efforts, remains under a temporary injunction issued by Judge Aileen Cannon, a Trump appointee, which expires February 24, 2026.
While the election-related volume was released under the Biden administration, the classified documents report is still withheld, with prosecutors maintaining it should remain confidential despite Smith’s testimony asserting his impartiality and the rule of law.
