In China, elderly caregivers like 70-year-old Shanghai resident Ms. Luo are finding legal solutions to secure their disabled children’s futures through "intended guardianship" agreements, a growing response to the crisis of over 7 million families relying on seniors for disability care and more than 180 million elderly living alone.
Though China’s Civil Code allows advance designation of guardians and estate managers, awareness remains low—over 90% recognize the need, but fewer than 3% act.
To address this, Shanghai updated its rules in November 2025 to allow notarization or on-site witnessing by government bodies and encourage oversight by social organizations, while Beijing issued similar guidelines, aiming to expand access to structured, reliable legal support for vulnerable seniors.
