The Trump administration has dropped its appeal of a federal court ruling blocking its 2025 policy threatening to cut federal funding from schools that practice diversity, equity, and inclusion.
The Education Department filed a motion to dismiss the appeal, allowing Judge Stephanie Gallagher’s August decision to stand.
She ruled the administration’s “Dear Colleague Letter” violated the First Amendment and federal procedural rules, finding it chilled educators’ free speech by threatening punishment for lawful efforts to promote diversity.
The guidance had warned schools they could lose funding if they considered race in admissions, hiring, or scholarships and required K-12 schools to certify they did not engage in DEI practices.
The case was brought by the American Federation of Teachers, with Democracy Forward calling the dismissal a victory for public education.
The department did not issue a public statement.
