Brian Allan Smith, 47, of Lowood, Queensland, became the first person charged under Daniel’s Law, Queensland’s new public child sex offender registry, after allegedly publishing identifying information from the system without authorization on January 1, 2026—the day it launched.
He appeared in Ipswich Magistrates Court on January 21, facing a charge under a child protection offender reporting prohibition order, with a maximum penalty of three years in jail.
The court adjourned the case to February 4, granting Smith bail.
His legal team suggested possible federal jurisdiction, but the magistrate ruled it a state-level matter.
The registry, created in honor of Daniel Morcombe, who was abducted and murdered in 2003, allows verified users to access photos and locations of high-risk offenders.
Since launch, nearly 105,000 people have accessed tier one data.
Police confirmed a swift response to the alleged breach.
Smith made no comment as he left the courthouse.
