Meta and WhatsApp are challenging a ₹213.14 crore fine and a five-year data-sharing ban imposed by India’s Competition Commission of India (CCI), arguing the CCI overstepped its authority by addressing data privacy, a matter for courts and lawmakers.
They claim the CCI’s decision lacked proper justification, ignored legal precedent, and failed to prove harm to competition or users.
The NCLAT previously paused the ban, citing risks to WhatsApp’s free business model, and ordered Meta to deposit half the fine.
The CCI maintains WhatsApp’s dominance stems from its 2014 acquisition and data monetization, while Meta contends other apps also track user data without scrutiny.
The case continues with the CCI set to present its arguments.
