In the Malviya Nagar case, the court dismissed Somnath Bharti’s petition due to a procedural failure: he did not implead the Congress candidate, Jitender Kumar Kochar, as required under the Representation of the People Act, rendering the petition non-maintainable despite allegations of vote manipulation and corrupt practices.
