A draft bill by Rep. Mike Nathe would provide free breakfast and lunch to all public and charter school students in North Dakota starting in the 2026-2027 school year, funded by a $65 million initial appropriation from the Strategic Investments and Improvements Fund.
The legislation, which would be part of state statute rather than the constitution, creates a dedicated state fund for school meals and allows tribal and private schools to opt in.
It does not require use of the Legacy Fund if other funding is available.
The bill must be approved by Legislative Management before consideration in a special session beginning January 21, 2026.
