A Santa Clara County judge has dismissed a lawsuit challenging the approval of a new Costco store in West San Jose, allowing the 165,000-square-foot project to proceed.
The resident group West Valley Citizens for Responsible Development had argued the city violated zoning rules and failed to conduct a proper environmental review, citing traffic, air quality, and public service concerns.
Judge Charles Adams ruled the environmental impact report showed good faith disclosure and no prejudicial errors.
The project, expected to create 250–300 jobs and generate $2 million annually in tax revenue, will replace vacant buildings and includes $2.5 million in safety improvements.
Construction is set to begin after permits are issued.
The plaintiffs have until late March to appeal.
