Teacher Enoch Burke, jailed for trespassing, released to challenge dismissal over student's name change, but barred from school grounds.
Enoch Burke, a teacher imprisoned since November for trespassing at Wilson’s Hospital School in County Westmeath, has been released from Mountjoy Prison by a High Court judge.
Judge Brian Cregan ordered the release to allow Burke time to prepare a legal challenge against the Disciplinary Appeals Panel reviewing his dismissal, citing "substantive" and "credible" concerns.
Burke, who claims his religious beliefs were violated by a student’s name and pronoun change in 2022, must not enter school property; any breach could result in immediate re-incarceration.
Despite the order, Burke stated he intends to return to work, calling the release a "travesty."
The court will hold a follow-up hearing to assess his compliance.
