Montana Supreme Court Justice Laurie McKinnon has been charged with a misdemeanor for allegedly failing to slow to 35 mph while passing a stopped emergency vehicle on U.S. Highway 287 in November.
The charge stems from a 2023 state law requiring reduced speeds near emergency vehicles with lights on.
McKinnon, who was returning from a family visit, said she tried to switch lanes but had to return due to oncoming traffic and was unaware of the specific speed requirement.
She plans to present her account at a January 20 hearing.
A first offense carries a fine of $100 to $500 and up to 90 days in jail.
She has served on the state’s highest court since 2013 and was reelected in 2020.
