The Supreme Court questioned Abu Salem, convicted in the 1993 Mumbai blasts, on his claim of completing a 25-year sentence after extradition from Portugal in 2005.
Justices Vikram Nath and Sandeep Mehta challenged his calculation, asking whether remission for good behavior was included and if such benefits apply under TADA.
The court directed Salem’s counsel to submit Maharashtra’s prison rules on remission within two weeks and set a February 9 hearing.
India had previously committed to releasing Salem after 25 years, per a 2002 treaty assurance to Portugal.
Salem also faces a life sentence for the 1995 murder of builder Pradeep Jain.
