Kenya’s High Court has allowed the regulatory approval process for Diageo’s proposed $2.3 billion sale of its 65% stake in East African Breweries to Japan’s Asahi to continue, despite a legal challenge from distributor Bia Tosha.
The court issued a temporary 11-day preservation order halting only final steps until January 20, 2026, while preparatory and statutory regulatory activities may proceed.
The dispute stems from a 2016 contract termination claim, but the court ruled it does not affect the transaction’s validity.
Final approval remains pending further judicial review.
