The Virginia Supreme Court has ordered a new trial in Appian’s $2 billion trade secret lawsuit against Pegasystems, rejecting Pega’s attempt to dismiss the case.
The court upheld evidence showing Pega allegedly hired a former employee, Youyong Zou, as a "spy" to steal Appian’s confidential software data, used it to improve its products, and concealed his identity.
The ruling also cited Pega’s efforts to access Appian’s systems after Zou lost access and internal communications referring to him as an “Appian spy.” While the original $2.04 billion verdict was overturned, the court found errors in how the burden of proof was applied and how access to trade secrets was assessed.
Appian plans to present its case again before a new jury, with both sides expected to appeal.
