A lawsuit has been filed in South Carolina challenging Governor Henry McMaster’s 2025 deployments of 300 National Guard troops to Washington, D.C., arguing the moves violate state law by lacking a declared emergency and bypassing D.C.’s consent.
Plaintiffs, including the ACLU of South Carolina and Democracy Forward, claim the deployments were politically motivated and improperly used state resources.
They seek a court ruling invalidating the actions and blocking future similar use of the Guard.
McMaster’s office defends the deployments as lawful under state authority to protect lives and support law enforcement, asserting the troops operate under a federal funding agreement while remaining under state command.
