Michigan's AG rules GOP House committee's funding halt unconstitutional, allowing spending to resume.
Michigan Attorney General Dana Nessel has ruled that a Republican-led House committee's use of a 1984 law to block $645 million in previously approved state funding is unconstitutional.
Her opinion, issued at the request of Senate Democrats, found the move violated the state constitution’s separation of powers, bicameralism, and presentment requirements by allowing a single committee to unilaterally halt funding without full legislative or gubernatorial approval.
The cuts affected programs including prenatal care, arts groups, Flint water recovery, and legal aid.
Nessel stated that once funds are appropriated, the executive branch can implement them without legislative interference.
