Pamela Smart, serving life without parole for her role in her husband’s 1990 murder, is seeking to overturn her conviction through a habeas corpus petition in New York and New Hampshire.
Her legal team argues that inaccurate transcripts of secretly recorded conversations misled jurors, flawed jury instructions emphasized premeditation without evidence limits, and her mandatory life sentence was not required by New Hampshire law for accomplices.
They also cite prejudicial media coverage and a scientific study on "expectation bias" affecting how jurors interpreted audio.
Smart, then 22, was convicted after an affair with 15-year-old William Flynn, the shooter, who and three others received reduced sentences and were released.
In 2024, Smart acknowledged her role in the crime for the first time.
New Hampshire’s attorney general maintains her trial was fair, and New York officials have not commented.
The petition remains pending.
