A federal judge has allowed the Department of Health and Human Services to resume sharing limited personal data—such as names and dates of birth—of undocumented immigrants enrolled in Medicaid with Immigration and Customs Enforcement, effective January 5, 2026.
The ruling by Judge Vince Chhabria in San Francisco lifts a previous temporary block, permitting only basic biographical information, not sensitive medical details or data on U.S. citizens and legal immigrants.
The decision follows a lawsuit by 22 states over privacy concerns and fears that data sharing could deter immigrants from seeking emergency medical care.
While HHS had previously shared broader data, including Social Security numbers and home addresses, the new order restricts the scope.
It remains unclear whether HHS has begun sharing data as of January 5.
