A Florida judge has ruled that the immigrant detention facility known as "Alligator Alcatraz" is not subject to state prison access laws, dismissing a lawsuit by five Democratic lawmakers who were denied unannounced entry in July 2025.
The facility, operated by the state’s Division of Emergency Management under Governor Ron DeSantis, is used to detain undocumented immigrants under federal authority and is not run by the Florida Department of Corrections or any local government.
Judge Jonathan Sjostrom determined it does not qualify as a state, county, or municipal jail under Florida law, meaning legislative oversight laws do not apply.
The decision affirms that individual lawmakers lack automatic access rights, with oversight instead reserved for authorized legislative committees.
