Scotland will replace its "not proven" verdict with guilty or not guilty starting Jan. 1, 2026, requiring 10 of 15 jurors for conviction.
Starting January 1, 2026, Scotland will abolish its "not proven" verdict, replacing the three-verdict system with guilty or not guilty, as part of the Victims, Witnesses, and Justice Reform (Scotland) Act.
The change, backed by victims’ groups, aims to reduce confusion and improve closure for survivors.
A two-thirds majority (10 of 15 jurors) will now be required for conviction.
Additional reforms include a specialist sex offences court, lifetime legal anonymity for survivors, and updated parole guidelines that prioritize victim impact and trauma-informed practices.
