Ireland's High Court upheld the IAA's authority to ground a skydiving plane and suspend a pilot’s license over safety concerns in 2022.
The Irish High Court ruled in 2025 that the Irish Aviation Authority (IAA) had legal authority to ground an aircraft and suspend a pilot’s licence linked to the Irish Skydiving Club in Kilkenny during safety inspections in August and September 2022.
The court dismissed a challenge by the club and its director, Eoin Nevin, who claimed the IAA lacked authority and inspectors were unqualified.
The IAA had been seeking inspections since 2021, citing inadequate safety checklists, outdated flight charts, and unreadable aircraft markings.
During a second inspection, the pilot refused to show documents without legal counsel, prompting the IAA to ground the aircraft and involve gardaí over safety concerns.
The aircraft was cleared in March 2024 after a follow-up inspection.
Judge Anthony Barr affirmed the IAA’s right to unannounced inspections to ensure aviation safety, stating no legal barriers existed and that non-cooperation undermined regulatory oversight.
